After the lender (bank) or association receives a judgment in the foreclosure case and the real property is sold through a Foreclosure Sale, there could be funds remaining after payment of all disbursements as indicated on the Final Judgment of Foreclosure.Those funds are called surplus funds. For example, there is a foreclosure judgment entered in the amount of $200,000. At the public auction, the real property sells for $250,000. This sale results in surplus funds amounting to $50,000. Tax deed sales are property auctions conducted by counties in the state to recoup unpaid taxes and associated fees and interest penalties.


For purposes of establishing entitlement to the surplus after the property has been remitted to the department, only the owner of record reported by the clerk of the court, or the beneficiary, as defined in s. 731.201, of a deceased owner of record reported by the clerk, is entitled to the surplus.


Once you have decided to use Nationwide Surplus Funds to assist you in recovering your surplus claim, we prepare all the documents for your notaried signature and then we submit all necessary paperwork to the county. If a probate is necessary, we hire the specializing attorney to coordinate with you and with us to initiate the legal process.


Nationwide Surplus Funds is only paid when we succeed in retrieving your surplus money. Our payment is a percentage of that retrieved surplus agreed to in contract with the client. All costs in the process are paid by us out of that percentage. There are no out of pocket costs to our clients.
